1. Agreement and acceptance

These Terms of Use ("Terms") form a binding agreement between you and Janma Labs Private Limited ("Janma", "Company", "we", "us" or "our") governing access to and use of the Janma mobile application, website at janma.ai, and related features and services (collectively, the "Service").

You may accept these Terms by an affirmative electronic action within the Service. Where the Service is made available without an acceptance screen, your access and use of the Service constitutes acceptance of these Terms to the extent permitted by applicable law. If you do not agree, do not use the Service.

The Privacy Policy and the Consent Notice are incorporated by reference. If there is a conflict concerning processing of personal data, the Privacy Policy will control; if a conflict concerns a specific paid feature, feature-specific terms will control only for that feature. Nothing in these Terms limits any non-waivable rights available under applicable consumer or other law.

3. Eligibility and children

The Service is intended for users aged 18 years and above. You represent that you are legally competent to enter into these Terms. Janma does not knowingly permit a child to create or operate an account.

Janma does not knowingly permit a child to create or operate an account. A parent or lawful guardian may submit a child’s birth particulars only where legally authorised to do so. Janma will apply enhanced safeguards to child data and will not knowingly use child data for behavioural advertising, targeted advertising or harmful profiling. When the DPDP child-data provisions commence, Janma will apply the verification and processing restrictions required by the applicable law.

4. Account and information

You must provide information that is accurate, current and complete and keep it updated. You are responsible for safeguarding account credentials and for activity through your account, except to the extent caused by Janma’s failure to maintain reasonable security safeguards or by circumstances for which you are not legally responsible.

If you suspect unauthorised access, notify support@janma.ai promptly.

5. Birth particulars and third-party information

The Service computes astrological charts from date, time and place of birth. The accuracy of the resulting chart depends on the accuracy of the information you submit. A difference in recorded birth time may change aspects of the chart and resulting Content.

You may submit birth particulars relating to another individual only where you are authorised to do so and have the legal basis required for that submission. For the compatibility feature, the other person’s name, date, time and place of birth are required. The compatibility calculation does not use the name; it is stored with the result so that the result can be displayed to you, and it is deleted when you delete your account. You must not use the Service or resulting Content to harass, discriminate against, defraud, stalk or make consequential decisions about another person without lawful authority and appropriate independent information.

Where Janma receives a request from a third-party individual whose birth particulars have been submitted by a user, Janma may verify the request and take reasonable action consistent with applicable law, including restriction, correction or deletion where required or appropriate.

6. The Service and content

Janma provides Vedic astrology charts, readings, forecasts, compatibility analyses, pañcāṅga and muhūrta information, and related features. All features are currently provided without charge. If Janma introduces paid features, the applicable price and terms will be displayed before any charge is made and will be governed by feature-specific terms.

The Service uses automated and artificial intelligence systems. AI-generated Content may be inaccurate, incomplete, inconsistent or unsuitable for a particular user. Astrological interpretation is presented for cultural, informational, reflective and entertainment-oriented purposes and is not established science.

7. No professional, medical, legal or financial advice

Janma’s readings are produced by Janma’s astrology engine from your chart. The wording of certain readings is written by an AI language model from sign-level content that does not contain your personal data. They are provided for reflection and general guidance — not medical, legal, financial, or professional advice. If you are in crisis, please contact a qualified professional.

Content is not medical, psychological, legal, financial, investment, tax, employment, insurance or other professional advice. Do not rely on Content for diagnosis, treatment, crisis response, investment or trading decisions, legal decisions, employment or housing decisions, or other high-impact decisions.

Janma is not an emergency or crisis service. If you are experiencing an emergency or are at risk of harm, contact an appropriate emergency service or qualified professional.

8. AI-specific terms

Janma uses an AI language model provided by Anthropic to write the wording of certain readings. This content is generated for each zodiac sign and shared by every user of that sign; no personal data about you is sent to the AI provider. Janma does not currently offer a conversational AI feature. If one is introduced, the Privacy Policy will be updated before launch to describe what is processed and by whom. Janma’s contractual position is that the provider does not use content supplied by Janma to train its models.

You must not use Janma Content or Service outputs to train, fine-tune, benchmark or evaluate an artificial intelligence or machine-learning system without Janma’s prior written permission, except to the extent such restriction would conflict with a non-waivable legal right.

9. Acceptable use

You must not:

  • use the Service unlawfully or to harass, threaten, defame, impersonate, deceive or harm any person;
  • submit or request content involving child sexual abuse, unlawful exploitation or other prohibited content;
  • use Content to discriminate against a person in employment, housing, education, credit, insurance, healthcare, marriage or another consequential context;
  • scrape, crawl, harvest, bulk-download, reverse engineer or attempt to extract Janma source code, prompts, proprietary rules, databases or security controls;
  • interfere with the security, availability or integrity of the Service or attempt unauthorised access;
  • create accounts through automated means or abuse technical limits;
  • resell, sublicense or commercially exploit the Service except as expressly permitted in writing;

10. Intellectual property

Janma and its licensors own or control the Service, software, interfaces, trade marks, databases, proprietary rules, prompts, documentation and other Company materials. Except for the limited licence expressly granted to you, no intellectual property right is transferred to you.

You may use Content generated for you for personal, non-commercial purposes and may save or share it for those purposes. You must not represent Janma-generated Content, proprietary calculations or Company materials as your own commercial product.

You retain rights you may have in original information or material you submit. You grant Janma the limited rights needed to host, store, transmit, process and display that material to provide the Service, support users, maintain security and comply with law, subject to the Privacy Policy.

11. Third-party services

The Service depends on the following providers: Firebase Authentication (Google) for sign-in; AstrologyAPI.com for astronomical and astrological calculations; Google Maps Platform for resolving the places you enter; MSG91 for sending one-time codes by SMS; DigitalOcean for hosting; and Anthropic for AI-written content. Where a provider processes personal data on Janma’s behalf, Janma maintains appropriate contractual and operational controls. The Privacy Policy describes what each provider receives. A third party’s own terms may apply where you contract directly with that third party.

The Service may depend on cloud hosting, artificial intelligence, speech recognition, analytics, communications, payment processing and app marketplace providers. Janma is responsible for its contractual and operational relationship with its processors, but third-party services may be governed by their own terms where you contract directly with them.

12. Availability and changes to the Service

Janma will use reasonable efforts to maintain the Service but does not guarantee uninterrupted, secure or error-free operation. The Service may be modified, suspended or discontinued for legal, security, technical, operational or commercial reasons. Janma will provide reasonable notice where practicable.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service and Content are provided on an "as available" basis and Janma does not warrant that any astrological reading, forecast, compatibility score or AI response will be accurate or produce a particular outcome. No disclaimer in these Terms excludes a statutory guarantee, consumer remedy, liability or other right that cannot lawfully be excluded.

14. Suspension and termination

Janma may suspend or terminate access where reasonably necessary for security, fraud prevention, legal compliance, material breach or misuse. Where appropriate and lawful, Janma will notify the user and provide an opportunity to address the issue.

You may close your account at any time through the Service or by contacting support@janma.ai. Account closure does not affect rights or obligations that by their nature survive termination. Personal data will be retained or deleted as described in the Privacy Policy and applicable law.

15. Limitation of liability

To the maximum extent permitted by law, Janma will not be liable for indirect, incidental, special or consequential loss arising from use of the Service. Subject always to non-waivable rights and liabilities that cannot legally be limited, aggregate contractual liability arising from the Service will not exceed the greater of (a) amounts paid by you to Janma in the three months preceding the event giving rise to the claim, or (b) INR 10,000.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, statutory consumer rights, data-protection obligations, or any liability that cannot lawfully be excluded or limited.

16. Indemnity

To the extent permitted by law, you agree to indemnify Janma against third-party claims directly arising from your unlawful use of the Service, your breach of these Terms, or your unauthorised submission of another person’s personal data. This clause does not require you to indemnify Janma for Janma’s own unlawful conduct or non-waivable statutory liability.

17. Grievance redressal and consumer complaints

Janma maintains a grievance mechanism for privacy and consumer complaints. Privacy concerns may be sent to grievance@janma.ai or support@janma.ai; consumer/service complaints may be sent to support@janma.ai. Consumer complaints will be acknowledged within 48 hours and redressed within one month where the applicable e-commerce rules require those timelines. Janma will publish and keep current the name and contact particulars of the designated Grievance Officer before launch.

18. Notices

Notices to users may be provided through the Service, email or other lawful electronic means. Notices to Janma may be sent to support@janma.ai or the registered office address stated above.

19. Changes to these Terms

Janma may update these Terms from time to time. Material changes will be notified through reasonable means before taking effect, where practicable. Continued use after the effective date may constitute acceptance only to the extent permitted by law.

20. Governing law and dispute resolution

These Terms are governed by the laws of India. Before commencing formal proceedings, the parties should attempt in good faith to resolve the dispute through the grievance/contact mechanism. Nothing in these Terms requires a consumer to waive, exclude or exhaust a statutory remedy before approaching a competent consumer forum or statutory authority.

Subject to non-waivable statutory rights, disputes may be referred to a sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996, with the seat at Gurugram, Haryana and proceedings in English. The courts at Gurugram will have jurisdiction over matters subject to the arbitration agreement, without excluding any mandatory jurisdiction granted to a consumer or other statutory forum.

21. General

  • Severability: if a provision is invalid or unenforceable, the remaining provisions continue to the extent permitted by law.
  • Waiver: failure to enforce a right is not a waiver of that right.
  • Assignment: Janma may assign the agreement as part of a merger, reorganisation or transfer of the business, subject to applicable law; you may not assign your account without Janma’s written consent.
  • No partnership, agency or employment relationship is created by these Terms.
  • These Terms, the Privacy Policy, the Consent Notice and applicable feature-specific terms constitute the agreement concerning the Service.
